Este artículo busca establecer un diálogo con la literatura internacional sobre justicia transicional y ofrecer un marco teórico crítico que permita analizar la experiencia reciente en Colombia. Para tal efecto, en la primera parte del artículo sostengo que la idea de justicia transicional es una construcción discursiva relativamente reciente en el escenario político y académico internacional, pero que, a su vez, ha experimentado diferentes momentos y transformaciones. En la segunda parte, el artículo ofrece un marco teórico que permita reflexionar sobre (...) la construcción de sentidos democráticos sobre la justicia transicional y los derechos de las víctimas en un escenario complejo como el colombiano. En tal sentido, con base en la perspectiva de campos sociales expuesta por Pierre Bourdieu (1992), sostengo que la justicia transicional es un espacio de confrontación y lucha entre sujetos sociales que cuentan con distintos acumulados de poder. Así mismo, me baso en perspectivas críticas en materia de derechos humanos y justicia transicional para resaltar la relevancia de sujetos sociales, como los movimientos sociales y las redes de derechos humanos, en la construcción de una justicia transicional “desde abajo”. The European Union’s Artificial Intelligence Act (AI Act) is a groundbreaking regulatory framework that integrates technical concepts and terminology from the rapidly evolving ecosystems of AI research and innovation into the legal domain. Precise definitions accessible to both AI experts and lawyers are crucial for the legislation to be effective. This paper provides an interdisciplinary analysis of the concepts of AI system, general purpose AI system, foundation model and generative AI across the different versions of the legal text (Commission proposal, (...) Parliament position and Council General Approach) before the final political agreement. The goal is to help bridge the understanding of these key terms between the technical and legal communities and contribute to a proper implementation of the AI Act. We provide an analysis of the concept of AI system considering its scientific foundation and the crucial role that it plays in the regulation, which requires a sound definition both from legal and technical standpoints. We connect the outcomes of this discussion with the analysis of the concept of general purpose AI system and its evolution during the negotiations. We also address the distinct conceptual meanings of AI system vs AI model and explore the technical nuances of the term foundation model. We conclude that rooting the definition of foundation model to its general purpose capabilities following standardised evaluation methodologies appears to be most appropriate approach. Lastly, we tackle the concept of generative AI, arguing that definitions of AI system that include “content” as one of the system’s outputs already captures it, and concluding that not all generative AI is based on foundation models. Sport is an emotional experience. Studies have shown that high emotional intelligence (EI) is associated with better sports performance, though different aspects of sports experience and their relationship with EI are still unclear. This study examined the possible relationships between sports experience and EI dimensions of undergraduate athletes. Likewise, according to the differences described in the literature between men and women, the secondary aim was to identify the possible relationship between EI and sports experience in both subgroups. A total of (...) 1784 [712 men (39.9%), 1072 women (60.1%); mean age = 21.3 years, SD = 4.2)] undergraduate athletes completed the Trait Meta Mood Scale and a sports experience questionnaire. Comparisons between groups were performed using Mann–Whitney-Uand H-Kruskal–Wallis tests and correlations between variables were analyzed using Spearman correlation. We found that the number of different sports practiced and the number of years practicing sports were positively associated with emotional repair (ER). However, the number of years practicing sports was negatively associated with emotional attention (EA). Male athletes who trained more and had a higher competitive level were more likely to show higher ER. In any case, it is necessary to take into account that all the associations were weak. Our study suggested that athletes tend to attend to and value their feelings and use positive thinking to repair their negative moods. (shrink)

We examine and test the environmental performance of family firms across 22 European countries and find that they exhibit better environmental performance than nonfamily firms. This result confirms prior research conducted in the United States. More specifically, we conclude that family firms engage in more substantive environmental actions than nonfamily firms. Furthermore, we hypothesize and confirm that family firms do not pay a financial price for lower emissions, which should facilitate the voluntary, non-instrumental adoption of pollution control practices. Finally, we (...) also find that the relationship between substantive environmental activities and financial returns is stronger among family firms that have family members on the board and are under the influence of the first generation. Dos místicos relativamente contemporáneos: Etty Hillesum y Benjamín González Buelta; dos estilos, dos contextos y una coincidencia establecida desde sus experiencias espirituales, en profunda conexión con la realidad, en medio de la vida y sus desafíos. Hillesum no habla propiamente de la experiencia mística, sin embargo, su proceso personal existencial en el duro contexto de guerra que le tocó vivir, la condujo a descubrirse profundamente habitada. Su experiencia de Dios le hizo posible comprender y gestionar el dolor en medio de (...) la guerra, así como la necesidad de ‘hacerse bálsamo sobre las heridas’ de sus hermanos judíos. Etty es una mística de ojos abiertos. Benjamín González Buelta ha profundizado en la comprensión de la mística, describiéndola y analizándola desde la experiencia de Dios en el contexto latinoamericano. Su reflexión permite hoy leer a Etty Hillesum desde la perspectiva del místico de ojos abiertos. (shrink)

The intuitive distinction between natural and unnatural properties (e.g., green vs. grue) informs our theorizing not only in fundamental physics, but also in non-fundamental domains. This paper develops a reductive account of this broad notion of naturalness that covers non-fundamental properties: for a property to be natural, I propose, is for it to figure in a law of nature. After motivating the account, I defend it from a potential circularity charge. I argue that a suitably broad notion of lawhood can (...) be defined independently of naturalness, if we help ourselves to the notion of a fundamental physical property. I end by showing how the notions of naturalness and lawhood that my account delivers help illuminate a number of other important philosophical notions, like causation, reference/meaning, and rational induction. Let ‘semantic relevance’ be the thesis that the wide semantic properties of representational mental states (like beliefs and desires) are causally relevant to behavior. A popular way of arguing for semantic relevance runs as follows: start with a sufficient counterfactual condition for causal or explanatory relevance, and show that wide semantic properties meet it with respect to behavior (e.g., Loewer & Lepore (1987,1989), Rescorla (2014), Yablo (2003)).This paper discusses an in‐principle limitation of this strategy: even the most sophisticated counterfactual criteria (...) systematically misclassify irrelevant properties as relevant when they stand in certain kinds of modal co‐variation or ‘entanglement’ relations to genuinely relevant properties. This entanglement problem, I argue, is more general and more serious than proponents of the counterfactual strategy have recognized: it threatens recent interventionist arguments for semantic relevance, and is not easily solved by appeal to proportionality or naturalness. I end by suggesting that proponents of semantic relevance may need to shift their attention from patterns of counterfactuals to the lawful psychological generalizations that explain them. (shrink)

This essay proposes a reductive account of robust macro-regularities. On the view proposed, regularities can earn their elite scientific status by featuring in good summaries of restricted regions in the space of physical possibilities: our “modal neighborhoods.” I argue that this view vindicates “nomic foundationalism”, while doing justice to the practice of invoking physically contingent generalizations in higher-level explanations. Moreover, the view suggests an explanation for the particular significance of robust macro-regularities: we rely on summaries of our modal neighborhoods when (...) reasoning hypothetically about “agentially accessible” possibilities. It is commonly thought that that the best system account of lawhood ((Mill (1843), Ramsey (1978)[fp. 1928], Lewis (1973)) makes available a nice explanation for why laws are ‘distinctively appropriate targets of scientific inquiry’ (Hall, 2015). The explanation takes the following general form: laws are especially valuable for agents like us because they efficiently encode a lot of valuable (non-nomic) information in a tractable format. The goal of this paper is to challenge this style of explanation: I argue that the (...) general principle it presupposes is in conflict with our best account of practical rationality. After considering and rejecting a number of proposals for dissolving the tension, I conclude that BSA proponents may need to scale back the explanatory ambitions of their theory; in particular, they may need to give up the hope of non-circular explanations of the value of nomic information. I end by outlining some challenges for the humean world-view that results after this shift. (shrink)

Se trata de examinar las relaciones entre amor, ética y justicia, adoptando cuatro perspectivas complementarias: en primer lugar, se aborda la confrontación con Freud, en su enconada diatriba contra el concepto de «amor al prójimo». En segundo lugar, se plantea la confrontación con Kant, bajo la forma de la disputa entre «amor» e «imperativo». Situados así en el terreno de la ética, se consideran las relaciones entre amor y justicia, sirviéndonos ante todo de los análisis de Ricoeur, para abordar finalmente (...) lo que podríamos denominar «el amor a los fuera de la ley», apoyándonos en algunos personajes literarios de Dostoievski. Resumen Este trabajo, de carácter exploratorio, descriptivo e interpretativo, estudia las actividades de imagen presentes en un conjunto de cartas electorales enviadas por los principales partidos políticos españoles a los ciudadanos de ese país entre 2004 y 2019; concretamente, las cartas electorales relativas a las elecciones al Parlamento Europeo celebradas en 2004, 2009, 2014 y 2019. Las cartas electorales constituyen una parte del discurso político escrito en las que el candidato a unas elecciones se dirige a los potenciales votantes con (...) un discurso persuasivo, orientado a conseguir su voto. En este contexto, las actividades que se llevan a cabo son principalmente de autoimagen, si bien es posible encontrar también actividades de cortesía y críticas hacia otros partidos políticos -u otros actores sociales-que se enmarcan en una descortesía muchas veces carente de identificación del sujeto concreto al que se dirige y que, en ese sentido, entendemos como despersonalizada. Este trabajo pone de manifiesto tales actividades, mediante el análisis y comparación de estas cartas, no solo de manera sincrónica sino también, cuando es posible, de manera diacrónica. Creemos que todavía no hay ningún trabajo que haya analizado este tipo de textos desde la perspectiva aquí planteada, por lo que consideramos que es un estudio que, además de original, puede abrir camino a otros investigadores que deseen realizar análisis similares o con los que establecer comparaciones. Preocupado por los trastornos psíquicos y decepcionado por los métodos que la psiquiatría de su tiempo manejaba, Freud mostró gran interés por las obras de Cervantes, principalmente por El coloquio de los perros y por El Quijote, en las que los temas de la realidad y de la ilusión, y de la relación entre cordura y locura son sus respectivos ejes centrales. Una de las posibles lecturas de la magistral obra cervantina (...) es la que lleva a desdibujar los límites entre razón y sinrazón, hasta encontrar incluso «la razón de la sinrazón», lo que nos haría ésta comprensible y explicable. Fantasía... (Ver más) realizada, realidad fantaseada, pocas cosas preocuparon más a Freud que hacer el deslinde entre ambas. Freud no es simple abogado de lo irracional, sino que trata de encontrar también «la razón de la sinrazón» que los neuróticos expresan en sus síntomas, los cuales pretendió explicar hasta en sus más mínimos detalles. In this work we discuss logical structures related to indistinguishable particles. Most of the framework used to develop these structures was presented in [17, 28] and in [20, 14, 15, 16]. We use these structures and constructions to discuss possible ontologies for identical particles. In other words, we use these structures in order to characterize the logical structure of quantum systems for the case of indistinguishable particles, and draw possible philosophical implications. We also review some proposals available in the literature (...) which may be considered within the framework of the quantum logical tradition regarding the problem of indistinguishability. Besides these discussions and constructions, we advance novel technical results, namely, a lattice theoretical structure for identical particles for the finite dimensional case. This kind of approach was not present in the scarcely literature of quantum logic and indistinguishable particles. (shrink)

The paper first examines the difference between Wolff’s demonstration of my present existence and Descartes’ intuitive connection of my thinking with my existence. The results of this investigation enable us to analyse two controversial answers to the question of the knowledge of existence in Wolff’s works. The first answer is from Jürgen Stolzenberg, who discusses Wolff’s proof of the statement: I am. The second is written by Luigi Cataldi Madonna, who investigates the concept of contingent existence in Wolff’s works. The (...) problems of the interpretations they propose are different. The first uses in his analysis meanings of central terms that were foreign to Wolff. The second does not pay attention to Wolff’s framework and aims. These difficulties in their interpretations distort what Wolff does and plans in his treatment of the knowledge of existence. Wolff builds a demonstration to prove how we know that we are, because for Wolff there is only science if we prove all that we claim. According to him, philosophy is a science. With this paper I plan to clarify the context of Wolff’s demonstration of my present existence as well as the demonstration itself, to which the analysis of the above two interpretations can contribute. The atomic hypothesis according to Ludwig Boltzmann. The scientific and philosophical importance of a controversial position at the close of the 19th century. This paper examines Boltzmann’s standpoint in the controversy over the existence of atoms between himself on the one hand and Mach, Ostwald, Helm and to some extent Duhem on the other hand. The latter wanted to develop a physics only constructed with perceptible phenomena. Because of the lack of empirical evidence of the atoms at that time they (...) did not accept them for the construction of physics. In contrast, Boltzmann found the acceptance of atoms to be a fruitful assumption, since for him the construction of physics required going beyond perceptible phenomena. Two different conceptions of nature and of the ways to know nature clashed in this disagreement between Boltzmann and his opponents. Op-posing one-sided positions, Boltzmann supported the hypothetical character of science, in which more than one basic hypothesis can be advanced: he was open to the possibility of fundamental revolutions in science. We investigated the causal responsibility attributions of adults and children to mechanical devices in the framework of the criticality-pivotality model. It establishes that, to assign responsibility, people consider how important a target is to reaching a positive outcome (criticality) and how much the target contributed to the actual outcome (pivotality). We also tested theoretical predictions about relations between the development of counterfactual thinking and assessments of pivotality. In Experiment 1, we replicated previous findings in adults using our task. In Experiment (...) 2, we administered this task and a brief counterfactual reasoning questionnaire to children aged between 8 and 13 years. Results showed that children also considered both criticality and pivotality when they attributed responsibility. However, older children were more sensitive than younger ones to pivotality. Also, we found a positive correlation between children’s pivotality judgements and a measure of counterfactual thinking. Results are discussed regarding the model’s relation to counterfactual thinking. (shrink)

This study analyzes the interests of Spanish audiences in travel magazines within the current context of press consumption. The objectives are to identify the readers' reading frequency and reasons for reading, what contents interest them, and what aspects of the photographs attract them. The methodology involves a structured questionnaire completed by a representative sample of the Spanish population (n=1000). The main results reveal a low reading frequency, great interest in practical information, preference for landscape photography (over the age of 54) (...) and nightlife photography (young people), and indifference regarding the journalistic source of the images. These data provide relevant information on which to adapt travel magazines' content strategy. (shrink)

Preserving dignity during the dying process requires reviewing the roles of those involved in the treatment, care methods and decision-making. This article examines the participation and responsibility assigned to nurses regarding decision-making in the final stages of life, as laid out in the Rights to and Guarantee of Dignity for the Individual During the Process of Death Act. This text has been analysed on the levels of socio-cultural practice and discourse practice, using the critical discourse analysis methodology. The results show (...) that, although the law is another result of the social trend of patient empowerment, the responsibility of the nurses is not recognised, and they are left out of the decision-making process in the final stages of life. There is no consensus in the literature about the nature of terrorism. The authors’ main claim is that this is ultimately the result of the coexistence of two senses of the term, the action and the actor sense, which are not fully congruent. Rather than trying to advocate a specific conceptualization, the authors provide in this article a map of the different ways in which scholars talk about terrorism. They identify first the set of terrorist actions and the set of (...) terrorist actors. Terrorist tactics are a variety of the power to hurt, based on the lack of military power. Terrorist groups are underground ones with no territorial control. When the two criteria meet, the core of terrorism exists: coercive violence perpetrated by underground groups. The ambiguity that surrounds terrorism is caused by two other possibilities: actors with some measure of territorial control adopting coercive tactics and underground actors adopting military tactics. Although it is not possible to remove this ambiguity in empirical research, scholars can at least identify it and analyze it. The authors illustrate the two senses of terrorism and their interaction by using the most comprehensive dataset on terrorist incidents, the Global Terrorism Database. (shrink)

La vida de cada cual es contingente, pero es una contingencia necesaria para una porción de vidas; aunque me atrevo a decir, incluso, que así es para la creación en continuidad. Creo que nosotros tenemos misión. La misión implica que aquello que no haga alguien quedará sin hacerse tal y como lo podría hacer esa persona. En otras palabras, la misión de cada cual, como la propia vida, exige y es disyunción,―o esto o aquello, así o de otro modo. Y (...) si tenemos en cuenta, que la realidad es sistemática, y que un sistema es orden de los elementos que se ve afectado por entero en caso de que suceda algo a alguno de los que lo componen, entonces para estar viviendo tal y como vivimos se nos revelan los otros como contingencias necesarias, imprescindibles. Bien podría hacer una aproximación a Pablo Posada desde la razón vital y algo habrá de ello a lo largo de estos párrafos, pero eso es una tarea prematura, como su muerte. (shrink)

A veces se argumenta que la acción tiene primacía sobre la cau salidad. Esto se puede entender de dos maneras: que la causalidad es una proyección de la acción al ámbito natural o que la causalidad presupone un agente que actúa. Defiendo que la primera tesis es falsa y que la segun da sólo liene sentido desde una teoría realista de las causas.

George Boolos has described an interpretation of a fragment of ZFC in a consistent second-order theory whose only axiom is a modification of Frege's inconsistent Axiom V. We build on Boolos's interpretation and study the models of a variety of such theories obtained by amending Axiom V in the spirit of a limitation of size principle. After providing a complete structural description of all well-founded models, we turn to the non-well-founded ones. We show how to build models in which foundation (...) fails in prescribed ways. In particular, we obtain models in which every relation is isomorphic to the membership relation on some set as well as models of Aczel's anti-foundation axiom (AFA). We suggest that Fregean extensions provide a natural way to envisage non-well-founded membership. (shrink)
